Statutory warranties and your rights
The Home Building Act 1989 (NSW) implies statutory warranties into residential building contracts - including that work will be done with due care and skill, in accordance with plans, and will result in a dwelling that is reasonably fit to live in. These warranties are a key foundation for many homeowner claims.
Disputes we handle
We act in disputes about defective and incomplete work, payment and progress claims, variations, delay, and termination of residential building contracts. We advise both homeowners pursuing claims and builders defending them.
NCAT proceedings
Many home building disputes are heard in the NSW Civil and Administrative Tribunal (NCAT). We guide clients through the entire NCAT process - from preparing the application and evidence to the hearing - and advise on time limits, which are strict and matter a great deal.
